Terms and Conditions of the Online Store
§ 1. General provisions
- These Terms and Conditions define the rules for using the online store available atwww.wearchartbeat.pl, including the rules for placing Orders, concluding Sales Agreements,fulfilling Orders, withdrawal from the Agreement, and the complaint procedure.
- The Terms and Conditions are made available to the Customer free of charge prior to the conclusionof the Sales Agreement, in a manner that enables their acquisition, reproduction and recording.
- In order to use the online store, it is necessary to have:
- a device with Internet access,
- a current web browser,
- an active e-mail account.
§ 2. Definitions
- Online store – the online service available at www.wearchartbeat.pl.
- Seller – Agata Szadkowska conducting business activity under the name Chartbeat Agata Szadkowska.
- Customer – an entity placing an Order in the online store.
- Consumer – a Customer who is a natural person making a purchase not directly related to their businessor professional activity.
- Entrepreneur – a Customer who is a natural person, legal person or organizational unit conductingbusiness or professional activity.
- Entrepreneur with consumer rights – a natural person concluding a Sales Agreement directly relatedto their business activity, where the content of the Agreement indicates that it does not havea professional character for that person.
- Product – a movable item offered for sale in the online store.
- Personalized Product – a Product made according to the Customer’s individual guidelines,in particular in terms of size, color, cut, markings or other features agreed upon to order.
- Sales Agreement – an agreement for the sale of a Product concluded between the Customerand the Seller at a distance.
- Order – a declaration of intent by the Customer directly aimed at concluding a Sales Agreement.
- Delivery – an activity consisting in delivering the Product to the Customer.
- Carrier – the entity carrying out the Delivery.
- Durable medium – a material or tool enabling the Customer to store information in a way that allowsaccess to it in the future for a period appropriate to the purposes for which the information is intended.
§ 3. Information about Products and prices
- Information about Products presented in the online store constitutes an invitation to conclude a Sales Agreement.
- Product prices are given in Polish zlotys (PLN) and/or in Euro (EUR) and are gross prices.
- The Seller reserves the right to:
- change Product prices,
- conduct promotional campaigns,
- introduce and withdraw Products from sale.
- The changes referred to above do not affect Orders placed before they enter into force.
§ 4. Placing Orders
- Orders are placed via the online store.
- The Customer is obliged to provide true, up-to-date and complete data necessary to fulfill the Order.
- The condition for placing an Order is:
- reading the Terms and Conditions,
- accepting the Terms and Conditions.
- The Sales Agreement is concluded at the moment the Seller confirms acceptance of the Order electronically.
§ 5. Payments
- The Customer makes payment for the Order in advance using the electronic payment methods available in the store.
- Order fulfillment begins after the payment has been credited.
- In the event of failure to make payment within 5 (five) days from the date of placing the Order,the Seller has the right to cancel the Order.
§ 6. Order fulfillment and Delivery
- The Seller fulfills Orders within up to 30 (thirty) days from the date the payment is credited.
- Delivery is made to the address indicated by the Customer in the Order form.
- The cost of Delivery is calculated automatically when placing the Order.
- The Seller reserves the right to divide the Order into several shipments at no additional cost to the Customer.
§ 7. Withdrawal from the Sales Agreement
- The Consumer and the Entrepreneur with consumer rights have the right to withdraw from the Sales Agreementwithin 14 (fourteen) days from the date of receipt of the Product, without giving any reason.
- The declaration of withdrawal from the Agreement should be submitted in particular by electronic means (e-mail).
- The Product is returned to the Seller’s address at the Customer’s expense.
- The returned Product must not show any signs of use, in particular traces of hair.
- The Customer is responsible for any reduction in the value of the Product resulting from using itin a manner exceeding what is necessary to determine its nature, characteristics and functioning.
- In the event that a returned Product shows traces of animal hair or requires additional cleaning in order to restore it to a condition suitable for further sale, the Seller reserves the right to deduct from the refund the costs of professional cleaning of the Product, proportionate to the degree of soiling.
§ 8. Exclusion of the right of withdrawal
- The right to withdraw from the Sales Agreement does not apply to:
- Personalized Products,
- Products made according to the Customer’s individual specifications.
§ 9. Complaints – non-conformity of the Product with the Agreement
- The Seller is liable for non-conformity of the Product with the Sales Agreement under the principlesset out in the Act of 30 May 2014 on consumer rights.
- A complaint should be submitted electronically, with a description of the non-conformity of the Product.
- The complained Product should be returned at the Customer’s expense to the Seller’s address.
- If the complaint is accepted, the Seller reimburses the Customer for the cost of returningthe complained Product.
- The Seller will respond to the complaint within 14 (fourteen) days from the date of its receipt.
§ 10. Personal data
- The Seller is the administrator of the Customers’ personal data.
- Personal data are processed in accordance with the provisions of Regulation (EU) 2016/679of the European Parliament and of the Council (GDPR), in particular on the basis ofArticle 6(1)(b) and (c) GDPR.
- Detailed rules for the processing of personal data are set out in the Privacy Policyavailable on the online store’s website.
§ 11. Final provisions
- The Terms and Conditions enter into force on the date of their publication on the online store’s website.
- The Seller reserves the right to amend the Terms and Conditions for important legal,technical or organizational reasons.
- Sales Agreements concluded before the amended Terms and Conditions enter into forceare governed by the version of the Terms and Conditions in force on the date the Order was placed.
- Matters not regulated by these Terms and Conditions shall be governed by Polish law.
